1. General. These general terms and conditions apply to all offers, orders, agreements and deliveries of products from OCTA Kiteboarding, hereinafter referred to as “OCTA”. By placing an order with OCTA, the customer agrees to these general terms and conditions. Where these terms refer to a “consumer”, this means a natural person acting for purposes outside their trade, business or profession. Mandatory consumer rights remain applicable at all times.

2. Products and Product Characteristics. OCTA develops and sells kiteboarding products and accessories, including kiteboard fins, board handles and camera accessories. Some OCTA products are manufactured using additive manufacturing / 3D printing. As a result, small cosmetic differences may occur between products, such as visible layer lines, minor colour differences or small surface variations. Such characteristics are inherent to the manufacturing process and are not considered defects, provided they do not affect the normal functionality and safety of the product. Images, renders, technical drawings, colours and dimensions on the website are intended to represent the product as accurately as possible. Minor deviations may occur.

3. Use and User Responsibility. Kiteboarding is a sport involving significant forces, speeds and risks. OCTA products are used within this sporting context. The user is responsible for checking whether the product is suitable and compatible with their equipment; correct installation according to available instructions; correctly securing all fasteners; inspecting the product before every session; discontinuing use when damage, cracks, deformation, excessive wear or loose components are identified; using appropriate protective equipment and following normal kiteboarding safety practices. An OCTA product must not be used if the user can reasonably suspect that it is damaged or unsafe.

4. Installation and Compatibility. The customer is responsible for checking compatibility with the relevant kiteboard or other equipment before installation and use. Descriptions such as “fits all”, “universal” or similar wording must be interpreted within the mounting standards and dimensions stated on the product page and do not guarantee that a product will fit every existing kiteboard without exception. To the extent permitted by law, OCTA is not liable for damage arising from incorrect installation, incompatible equipment, incorrect fasteners, insufficiently tightened fasteners or installation that deviates from the instructions.

5. Inspection and Wear. OCTA products may be exposed during kiteboarding to high forces, impacts, sand, salt water, UV radiation and temperature changes. Users must therefore inspect products regularly. Normal wear and tear is not considered a defect for which OCTA is responsible. This also applies to damage resulting from impact, crashes, jumping, incorrect landings, contact with the seabed or obstacles, transport, improper storage or use outside what can reasonably be expected from the product.

6. Modifications. Modifying, drilling, sanding, heating, bonding or otherwise altering an OCTA product is done at the user’s own risk. OCTA cannot guarantee the performance or safety of a product after it has been modified by the user or a third party. The same applies when fasteners or installation methods are used other than those intended or recommended by OCTA.

7. Liability. OCTA is only liable for damage to the extent that such liability arises from applicable mandatory law. To the extent permitted by law, OCTA is not liable for damage resulting from: incorrect or improper use; incorrect installation; use of a visibly damaged or worn product; modification of the product; incompatibility with other equipment; failure to carry out reasonable inspections before use; use outside the intended application of the product. Kiteboarding inherently involves risks. OCTA cannot be held liable for the normal risks associated with participating in the sport that are not caused by a defect for which OCTA is legally responsible. Nothing in these terms excludes liability that cannot be excluded or limited under mandatory Dutch or European law.

8. Warranty and Defects. OCTA provides no additional commercial warranty unless explicitly stated in writing for a specific product. This does not affect the statutory warranty. A consumer is entitled to a product that meets what they may reasonably expect from it. Statutory warranty does not apply to problems resulting from, for example, incorrect use, damage caused by the user, normal wear and tear or other circumstances for which OCTA is not responsible. If a customer suspects a manufacturing fault or other defect, they should contact OCTA as soon as possible and, where possible, provide photographs and a description of the issue.

9. Prices and Payment. All consumer prices displayed on the website include applicable VAT unless explicitly stated otherwise. Any shipping costs are displayed before the order is completed. Payments are processed through the payment methods offered during Shopify checkout. An order becomes final after it has been successfully placed and confirmed, subject to the consumer’s statutory rights.

10. Delivery. OCTA aims to process and ship orders within the timeframe stated on the website. Stated delivery times are indicative unless a binding delivery date has been explicitly agreed. OCTA is not responsible for delays caused by carriers to the extent that such delays cannot be attributed to OCTA. Statutory consumer rights in the event of delayed or non-performed delivery remain applicable. The customer is responsible for providing correct address details.

11. Right of Withdrawal and Returns. Consumers purchasing online generally have the statutory right to withdraw from the agreement within 14 days after receiving the product without giving a reason. After notifying OCTA of the withdrawal, the consumer has a further 14 days to return the product. The direct costs of returning the product are borne by the consumer. OCTA does not provide a free return label and does not reimburse these return shipping costs, unless OCTA is legally required to do so or has agreed otherwise in advance. The product should, as far as reasonably possible, be returned complete and carefully packaged. The consumer may inspect the product in the same way that would reasonably be possible in a physical store. If the product has been used beyond what is necessary to establish its nature, characteristics and functioning, the consumer may be liable for any resulting reduction in value. In the case of a valid full withdrawal, OCTA refunds the purchase price and any legally required original standard delivery costs. Additional costs resulting from the customer choosing a more expensive shipping method for the original order do not have to be refunded.

12. Returns of Used Products. The right of withdrawal is intended to allow a product to be assessed. A kiteboard fin that has actually been mounted and intensively used on the water may show wear, damage or signs of use that go beyond what is necessary for assessment. Where this results in a reduction in value, OCTA may deduct this reduction in value from the refund within the limits permitted by law.

13. Product Safety. The user must immediately stop using an OCTA product if a safety issue is suspected. If OCTA determines that a product or product series may present a safety risk, OCTA may inform customers and take appropriate measures, including inspection, repair, replacement or recall where necessary or legally required.

14. Intellectual Property. All designs, images, product photography, texts, logos, trade names, technical drawings, CAD designs and other content developed and published by OCTA remain the property of OCTA or the relevant rights holder, unless otherwise stated. Making a design available through an external platform, including a 3D printing platform, does not automatically transfer commercial rights. Such files are also subject to the licence terms stated with the relevant file or platform.

15. Complaints. Complaints may be submitted using the contact details listed on the OCTA website. When submitting a complaint, please include the order number, a clear description and, where relevant, photographs of the product. OCTA will aim to handle complaints within a reasonable period.

16. Force Majeure. OCTA is not liable for failures that cannot reasonably be attributed to OCTA, including serious disruptions involving carriers, natural disasters, government measures, disruptions affecting essential service providers and other situations of force majeure. Mandatory consumer rights remain applicable.

17. Applicable Law. Agreements with OCTA are governed by Dutch law. This choice of law does not deprive consumers residing in another EU country of mandatory consumer protection available to them under applicable European law.
